This Privacy Policy governs the manner in which SongCat Music Inc. collects, uses, maintains and discloses information collected from users (each, a "User") of the http://songcat.biz website ("Site"). This privacy policy applies to the Site and all products and services offered by SongCat Music Inc.

Personal identification information
We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, place an order, subscribe to the newsletter, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

Non-personal identification information
We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

SongCat Music Inc. may collect and use Users personal information for the following purposes: - To improve customer service    Information you provide helps us respond to your customer service requests and support needs more efficiently.- To personalize user experience    We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.- To improve our Site    We may use feedback you provide to improve our products and services.- To process payments    We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.- To run a promotion, contest, survey or other Site feature    To send Users information they agreed to receive about topics we think will be of interest to them.- To send periodic emails. We may use the email address to send User information and updates pertaining to their order. It may also be used to respond to their inquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site.

We do not sell, trade, or rent Users personal identification information to others. Terms and Conditions ("Terms")Last updated: April 1, 2015Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the http://songcat.biz website (the "Service") operated by SongCat Music Inc. ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. Links To Other Web SitesOur Service may contain links to third-party web sites or services that are not owned or controlled by SongCat. SongCat has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that SongCat shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Termination: We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Music Production and Demo Production

SongCat Music Inc. offers three tiers of Music production

Basic Production: SongCat will create a rough recording with 1 live or virtual instruments and lead vocals.

Advanced Production: SongCat will create a three piece instrumental track with professional quality session musicians and record lead vocals with a vetted session singer to it.

Pro Production: SongCat will record a full band (up to seven instrument tracks) song with professional quality session musicians. One of SongCat's vetted vocalists will perform lead vocals and basic harmonies to the instrumental.

SongCat may use live instruments or virtual instruments depending on need and genre of the song. Most songs are a mix of both, however, in some cases only virtual instruments are are required (most common in the genres Dance, House, EDM) or only live instruments are required (most common in the genres Country, Rock). Please note: The Basic package most likely will be played with virtual instruments.

The client has to provide at the very least a lyric sheet, name a reference song and decide between male and female vocals. However, additional information such as chord sheet, notes, requests for specific instruments or vocalists are welcome. All orders have to be paid in advance. SongCat Music Inc. will commence work as soon as possible after payment of deposit cleared. Normal turnaround time for a song is up to approx. four weeks, however, this can be longer in some special circumstances.

The client will receive a high quality wav file of the mixed song, a wav file of the instrumental track and an mp3 file of the mixed track. Other formats upon request including CDs or memory stick (additional fees may apply).

All work is work for hire and SongCat does not claim any royalties or copyright to performed work. The music can be used for any purpose by the client including streaming on youtube, soundcloud or other services. Pitching to artists, labels, publishers, TV or Film opportunities. The vocals of our session singers are protected by performance rights. It is not allowed to commercially publish (on iTunes, Amazon, etc.) the song with the vocals of our session singer. The song needs to be re-recorded by a different singer. The same music instrumental track can be used for this without any restrictions. If the client wishes to release the song commercially with SongCat's session singer vocals, please email info@songcat.biz. Additional fees may apply and a release cannot be guaranteed. This will be decided on a case by case basis by the session singer directly. SongCat only acts as a messenger between the client and session singer.

All productions (except Basic Package) include one free modification. Every additional modification incurs a $15 fee. A modification is changing or swapping one instrument or the way an instrument is played, changing or re-doing one vocal track with the same vocalist or changing the mix or master of the song. Changing the vocalist after recording the song will incur a $100 fee. A complete redo of the entire song (starting from scratch) is a new order but SongCat Music Inc. offers the same package for 50% of the regular price listed on www.songcat.biz. SongCat Music Inc. may use (snippets of between 30 and 60 seconds of songs we produce to promote our services by uploading the sample to Soundcloud, Youtube, Soundclick or other social media platforms. If you don't want us to use a sample of your song please inform us.

Vocalists for hire
One free modification is included in all vocalist for hire packages. The vocals of our session singer are protected by performance rights. It is not allowed to commercially publish (on iTunes, Amazon, etc.) the song with the vocals of our session singer, however the client may publish the song on free streaming services such as Youtube or Soundcloud. If the client wishes to release the song commercially with SongCat's session singer vocals, please email info@songcat.biz.

Other services
All work is considered work for hire and the song can be used without any restrictions by the client. SongCat Music Inc. does not claim any rights to the music. Every package has one free modification included. Additional modifications cost $15

Deposit and Payment
All Productions have to be paid in advance. Payments are non-refundable. Refunds are offered on a case by case basis.

Cancellation

Clients have the right to cancel their order prior to SongCat commencing the recording process. To cancel, please email info@songcat.biz. We will inform you of the current status. If the recording process hasn't commenced, we will cancel your order and issue a refund to your original form of payment. SongCat will charge a $20 cancellation fee for all cancellations which will be deducted from the refund.
Please note: It is not possible to cancel a production after we start the recording process.


File Storage
SongCat is not obligated to store client's files beyond delivery of the service. However, depending on space on the company's server, SongCat might store files up to six months in case the client lost his/her files.

Governing Law
These Terms shall be governed and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
